First the University of Wisconsin band was suspended indefinitely while allegations of alcohol abuse and sexual misconduct were being investigated, now legal issues apparently kept celebrated sophomore defenseman Brendan Smith from playing in Wisconsin's season opener at Boston College last Friday night.

UW Police cited Smith Sept. 19 for a series of traffic violations, including operating a motorcycle under the influence of alcohol, a blood-alcohol level over .10, underage drinking and having an illegal passenger on his motorcycle.

It's not yet known if Smith, a 19-year-old from Mimico, Ontario, will play for the Badgers Saturday night at New Hampshire.

Smith is a first-round NHL draft pick of Detroit in 2007.

UW coach Mike Eaves didn't return a message left on his cell phone Saturday afternoon.

The incident last month is third involving Smith this year.

A charge of having an illegal passenger on his motorcycle Jan. 29 was dismissed in January.

After an incident April 16, Smith was found guilty of interfering with a traffic signal/sign and paid a fine of $312. Charges of underage drinking and resisting arrest were dismissed.

Two other Badgers players -- sophomore defensemen Cody Goloubef and Ryan McDonagh -- were cited and fined along with Smith for the incident in April.
